Article 1. Position and function
1. Department of Foreign Affairs (DoFA) is a specialized agency under Quang Tri Provincial People's Committee (PPC). DoFA has the function of advising and assisting PPC in performing the state management of Quang Tri’s foreign affairs and national border and territorial work (hereinafter referred to as foreign affairs). The department is also responsible for public services under its management in accordance with the state law.
2. The Department of Foreign Affairs performs the function of advising the Provincial Party Committee through the Party Committee's Personnel Committee on the policy of international integration, the orientation of expanding relations and the comprehensive implementation of foreign affairs; organizing and managing the Party's foreign affairs in the province according to the Party's regulations.
3. The Department of Foreign Affairs has legal entity, its own seal and bank account. Its structure, personnel and operation are under the direction and management of the Provincial People's Committee. Meanwhile, it is subject to the direction, guidance and examination the Ministry of Foreign Affairs in terms of profession.
Article 2. Missions and powers
1. Submit to the Provincial People's Committee:
a) Drafts of foreign affairs decisions, directives and documents under the authority of the Provincial People's Committee.
b) Drafts of long-term, five-year and annual master plans, plans, programs and projects on foreign affairs; drafts of programs and measures to implement the state administrative reform tasks on foreign affairs under DoFA's management.
c) Drafts of documents defining conditions, standards and titles for heads and deputy heads of organizations and units under DoFA.
2. Submit to the Chairman of the Provincial People's Committee:
a) Drafts of decisions and directives under the authority of Chairman of Provincial People's Committee on local foreign affairs.
b) Drafts of decision on establishment, merger, division, dissolution of DoFA’s organizations and units as prescribed by law.
3. Implement approved legal documents, master plans, plans, programs, schemes and projects on local external affairs; provide information, propagate, disseminate, guide, inspect and supervise the implementation of fields under DoFA's management.
4. Advise the Provincial Party Committee on foreign affairs:
a) Orientations for the province’s external relations expansion, international integration guidelines and roadmap; developing guidance documents, thematic resolutions, programs, plans and proposals for Provincial Party Committee’s external activities; periodically or extraordinarily summing up and proposing measures related to Provincial Party Committee foreign affairs.
b) Thoroughly understand and implement foreign affairs guidelines, policies and regulations of the Party and the State.
c) Monitor and urge the implementation of foreign affairs policy of the Provincial Party Committee, the implementation of the Party's external activities in accordance with the guidelines and programs approved by the Provincial Party Committee.
d) Acting as a focal point to assist the Provincial Party Committee in uniformly managing local foreign activities; coordinate the external activities of the Provincial Party Committee, the authority, the Fatherland Front and local mass organizations.
5. Regarding international cooperation:
a) Advise the local cooperation and international integration in accordance with the Party's foreign policy and State laws.
b) Formulate, and organize the implementation of, local cooperation and international integration plans, schemes on establishing local cooperative and cooperative relations with foreign partners, and report to the Ministry of Foreign Affairs according to regulations.
6. Regarding foreign economic affairs:
a) Assist the Provincial People's Committee in economic diplomacy, planning and implementing external activities to develop local socio-economy.
b) Act as the focal point between the Provincial People's Committee and the Ministry of Foreign Affairs and Vietnamese representative agencies abroad in promoting and introducing Quang Tri’s potentials and strengths; supporting the implementation of trade promotion, investment, tourism, the protection of legitimate rights and interests of local economic organizations abroad.
7. Regarding foreign cultural affairs:
a) Assist the Provincial People's Committee in cultural diplomacy, formulating and implementing programs and action plans of the Cultural Diplomacy Strategy in each period.
b) To act as the focal point between the Provincial People's Committee and the Ministry of Foreign Affairs and Vietnamese representative agencies abroad in organizing external cultural events in the province and introducing, promoting local people and culture abroad.
8. Regarding oversea Vietnamese:
a) Implemente programs, plans and policies for local overseas Vietnamese.
b) Provide information about the Party and State's guidelines and policies towards overseas Vietnamese; mobilize, guide and support overseas Vietnamese and their relatives in working, business investment, living and studying in the province.
c) Periodically review, evaluate and propose solutions for overseas Vietnamese issues and their relatives in the province, report to the Ministry of Foreign Affairs as prescribed.
9. Regarding consular work and protection of citizens:
a) Manage the entry and exit of officials and employees who use diplomatic and official passports; receive dossiers, inspect, manage and request the granting, extension, modification and supplementation of diplomatic and official passports in localities according to regulations.
b) Handle issues arising in the citizenship protection for oversea Vietnamese in the province; protect local fishermen in terms of foreign affair interests and consular work for overseas Vietnamese in the province.
c) Act as the focal point in receiving and returning the application results for consular certification and legalization in the province when authorized by the Ministry of Foreign Affairs; receive and return the results of the application for permission to use APEC business travel cards.
10. Regarding national border and territory work:
a) Act as the standing agency of the Provincial People's Committee on border work and national territory; assist the Provincial People's Committee in performing the state management function of border and territorial affairs in the province in accordance with the law and the guidance of the Ministry of Foreign Affairs and relavant ministries and branches.
b) Monitor, synthesize and report to the Provincial People's Committee and the Ministry of Foreign Affairs on the implementation of international treaties about national borders and territories and about issues arising on land and sea borders in the province.
c) Organize training courses to disseminate Party and State laws and policies on national borders and territories; guide, inspect and manage border documents, maps and records under provincial management; inspect, urge and guide local agencies and units on the State management issues on borders and territories.
11. Regarding the foreign reception:
a) Perform the state management of foreign protocol in the province.
b) Propose, develop and promulgate legal documents on foreign protocol in the province; inspect and guide the implementation of foreign protocol regulations on reception at agencies, units and localities.
c) Preside over the reception and logistics for provincial leader delegations visiting and working abroad; implement foreign protocol, recieve international delegations visiting and working with provincial leaders or transiting in the province.
12. Regarding the foreign affairs information:
a) Act as the focal point of relationship with the Ministry of Foreign Affairs and overseas Vietnamese representative agencies in implementing programs and plans on external information and propaganda of the province approved by the provincial People's Committee.
b) Provide the Ministry of Foreign Affairs and functional agencies the province’s information for the external propaganda; coordinate with Vietnamese representative agencies abroad in implementing foreign information activities, advertising the province’s images in foreign countries.
c) Unify the management of foreign journalists working in the province; develop program, receive journalists and provide provincial leaders’ answers, provide oriented information, monitore and manage foreign journalists in accordance with the law.
13. Regarding the organization and management of inbound and outbound delegations:
a) Perform the state management of foreign business delegations of provincial leaders and agencies, units, localities (outbound delegations) and international delegations visiting and working in the province (incoming delegations).
b) Organize foreign business trips for provincial leaders; act as the focal point with the Ministry of Foreign Affairs, the Central Foreign Affairs Committee and Vietnamese representative missions abroad to support, guide and manage outbound delegations according to regulations; appraise outbound delegation, monitor, collect and synthesize delegations under the management of the Provincial Party Committee and Provincial People's Committee.
c) Develop and implement plans and projects to recieve foreign delegations to visit and work with provincial leaders; appraise proposals and recommendations of departments, agencies, branches and localities about the provincial leaders receiving foreign visitors; collect statistics of inbound delegations under the management of the Provincial Party Committee and Provincial People's Committee.
14. Regarding the organization and management of international conferences and seminars:
a) Organize and manage international conferences and seminars under the decision of the Chairman of Provincial People's Committee.
b) Act as the focal point for receiving dossiers and appraising contents of international conferences and seminars; guide, inspect local agencies and units to implement the regulations on international conferences and seminars organization and management.
15. Regarding the signing and implementation of international agreements:
a) Perform the state management of international agreement signing and implementation in the province.
b) Monitor and accelerate the implementation of the signed agreements; report and consult the competent authorities on issues arising in the signing and implementation of international agreements in the province.
16. Regarding foreign non-governmental work:
a) Act as the focal point assisting the Provincial People's Committee in performing the state management for FNGO activities in the province; give opinions on the grant, extension, amendment, supplement and revocation of the Registration certificate and other activities of FNGOs in the province; guide and support FNGOs in procedures and in the survey, formulation and implementation of sponsored projects in accordance with law; inspect and supervise the activities and employees of FNGOs in the province; report to the Ministry of Foreign Affairs and COMINGO according to regulations.
b) Manage relation activities and FNG aid mobilization of the province; build programs, plans and support agencies, units and localities in mobilizing FNG aid.
c) Appraise programs, projects and aids from FNGOs to meet foreign political requirements; urge financial management and report of FNG aid.
d) To be the standing unit of the FNGO Committee of the province.
17. Regarding the diplomatic inspection:
a) Carry out administrative and specialized inspection in the province according to regulations.
b) Inspect agencies, organizations and individuals’ implementation of policies, laws and tasks under the management of the Department.
c) Guide, inspect and settle complaints and denunciations, and prevent and fight corruption; guide and inspect the units under the Department to comply with the general law provisions on inspection and settlement of complaints and denunciations, and prevent and fight against corruption, practice thrift and fight wastefulness according to regulations; propose to suspend the implementation or cancel the illegal provisions discovered through the inspection work.
18. Regarding the work of building professional foreign knowledge:
a) Propose, develop and implement programs on building foreign affairs knowledge, expertise, and skills for civil servants in the province.
b) Act as the focal point to coordinate with the Ministry of Foreign Affairs and relevant agencies in implementing foreign affairs and international integration programs for civil servants in the province.
19. Make periodic and unexpected reports on the performance of foreign tasks according to regulations.
20. Implement the administrative reform according to objectives and contents of Provincial People's Committee’s administrative reform program, apply science and technology; develop information systems, database to serve the state management of foreign expertise and profession; coordinate with the Ministry of Foreign Affairs in building a nationwide database system on local foreign activities.
21. Stipulate the functions, duties, powers and working relationships for units under the Department; provide structure and personel management, implement salary regimes, policies, remuneration, training, appointment, dismissal, commendation and discipline for civil servants and public employees under the Department’s management in accordance with the law and under the decentralization of Provincial People's Committee.
22. Manage assigned finance and assets and disburse the allocated budget according to the provisions of law and decentralization of the Provincial People's Committee.
23. Perform other duties assigned by the Provincial Party Committee and Provincial People's Committee.
